Thank you for visiting our learning platform. In this regard, we respect your privacy and guarantee the protection of your personal data by collecting, processing, and using them in conformity with the content of these data protection provisions and the applicable German data protection statutes.

In particular, we comply with the EU General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (Bundesdatenschutzgesetz, BDSG). In terms of internet use, we are guided by the German Telemedia Act (Telemediengesetz, TMG) for the purpose of protecting your personal data.

In the following, we explain what information we collect during your visit to our website and how we use it. In the following, we explain what information we at bbw Hochschule - University of Applied Sciences collect during your visit to our learning platform and how we use it.

General information concerning data processing


Scope of the processing of personal data
As a rule, we collect and use the personal data of our users only to the extent necessary in order to provide a functioning website, as well as our content and services. The personal data of our users is normally collected and used only with the user's consent. An exception applies in those cases where it is not possible for practical reasons to obtain prior consent and the processing of data is permitted by statutory provisions.

Legal basis for the processing of personal data
To the extent that we obtain the consent of the data subject for processing operations involving personal date, the legal basis is Article 6(1)(a) GDPR. Where the processing of personal data is necessary for the performance of a contract to which the data subject is party, the legal basis is Article 6(1)(b) GDPR. This also applies to processing operations that are necessary in order to take steps prior to entering into a contract. Where the processing of personal data is necessary for compliance with a legal obligation (statutory provisions) to which our company is subject, the legal basis is Article 6(1)(c) GDPR. Where the processing of personal data is necessary for the purposes of a legitimate interest pursued by our company or by a third party, and such interests are not overridden by the interests or fundamental rights and freedoms of the data subject, the legal basis is Article 6(1)(f) GDPR.

Data erasure and storage period
The personal data of the data subject are erased or blocked once the purpose for storage no longer exists. Personal data may also be stored if this was specified by European Union or national law in regulations, statutes, or other provisions to which the controller is subject. Data are also blocked or erased when a storage period specified by the aforementioned laws expires, unless it is necessary to continue to store the data for conclusion or performance of a contract.

Learning platform at bbw Hochschule - University of Applied Sciences


Description and scope of data processing
When you register as a user on the learning platform ( lernportal.bbw-hochschule.de), the data that you enter or that are automatically generated with your use are processed. To the extent that they refer to you personally and not to an assumed identity ("guest"), these data are personal data. For this reason, the relevant arrangements in data protection law also apply to the learning platform.

When you set up an account, we collect your last name, first name, email address, and place of residence. These data are stored in a database. After logging in, you can view these data at any time by clicking on your name (upper right-hand corner of the screen or at the bottom of the page). You can revise or supplement these data in your personal profile (e.g. profile photo, other names, personal interests, and optional entries, such as address and contact data).

Your entries can be viewed by other course participants and generally by other trainers and administrators. As a rule, by adjusting the settings in your personal profile, you can hide, e.g. your email address so that it cannot be viewed by other users.

You will receive a username and a password to log in. The first time you log in, you will be prompted to change this password. In addition, you must confirm that you have taken note of this Data Protection Policy.

In your personal profile, you can choose how you would like to receive email from lernportal.bbw-hochschule.de (e.g. on an individual basis or as daily compilations). You can adjust this setting at any time.

If you use the messenger function, the texts that you send to other users can be seen by trainers and administrators. If you prefer to avoid this, please use your email system and write emails in order to send messages to other users.

Your usage data, i.e. also log data, remain stored on lernportal.bbw-hochschule.de. They are accessible to the administrators of the learning portal and the head of the respective classroom, but not to other students (other than data in connection with forums). Forum posts remain available at a later date, even if you are no longer an active user. These posts are comparable to letters to the editor sent to a newspaper. They can be read even years after they were published.

The classrooms on lernportal.bbw-hochschule.de are not public. They are also not captured by search engines, e.g. by Google. If you are no longer registered in a classroom, your contact data can no longer be viewed by other users. As a rule, by adjusting the settings in your personal profile, you can hide, e.g. your email address so that it cannot be viewed by other users

This does not apply to course teachers or administrators. Note: If courses not accessible to the public are set up in a Moodle system, the course content and user contributions obviously cannot be found by search engines. The stored data are not disclosed to other persons or entities, including in anonymised form.

Legal basis for data processing
The legal basis for the processing of data is the performance of the study contract, as well as our legitimate interest in data processing in connection with making the learning portal available.

If you upload a photo of yourself, you thereby consent to the publication of the photo. Please be aware that uploading a photo is voluntary and has no impact on the use of the learning portal. The same applies to additional information that you provide about yourself.

Purpose of data processing
Die Personal data are processed for the purpose of providing and conducting our e-learning offerings in connection with the course offerings.

Storage period
The personal data collected by us for conducting the course of study are stored until expiry of the statutory retention (six years after the end of the calendar year in which the course of study was ended) and then erased, unless in accordance with Article 6(1)(c) GDPR, we are obligated on the basis of retention and documentation duties prescribed by tax or commercial law (the German Commercial Code (HGB), the German Criminal Code (StGB), or the German Fiscal Code (AO)) to store them for a longer period or in accordance with Article 6(1)(a) GDPR, you have consented to storage for a longer period. For instance, we are obligated to store grades for a period of 30 years.

Ability to object and remove
You have the ability to object at any time to the processing of your data. For this purpose, we have set up the email address widerspruch@bbw-hochschule.de eingerichtet.

Please be aware that in the event of an objection, it is not possible to access the learning portal.


Webinars/webcats and web meetings


Teachers have the ability to offer courses on basic and advanced training measures with various topics in the form of webinars/webcasts or web meetings if an in-person session is not possible.

Registration is required in order to participate in a webinar/webcast or web meeting. For conducting webinars/webcasts and web meetings, we use the products:

    Note: We use WebEx as an offer of Telekom. The service is provided on european servers.

The providers make a registration link available to us for registration. As part of the registration process, the following data, among others, are collected:

  • Email address

We use your email address to send the registration confirmation.

The legal basis for the processing of data is the performance of the study contract, as well as our legitimate interest in data processing in connection with making the learning portal available.

Purpose of data processing
We process personal data solely for the purpose of providing a platform for online communication, such as videoconference rooms.

Storage period
Video recordings are not stored. The registration and invitation data are erased once they are no longer needed for fulfilling the purpose for which they were collected (ending of the online course).

Ability to object and remove
You have the ability to leave the online course or end the session at any time.

Email contact


Description and scope of data processing
We provide email addresses for making contact through the website. If contact is made, the personal data that are transmitted with the email are stored.

Legal basis for data processing
The legal basis for the processing of data is our legitimate interest in data processing in connection with enabling enquirers to make contact.

Purpose of data processing
We process personal data solely for dealing with the contact that was made.

Storage period
The data are erased once they are no longer needed for fulfilling the purpose for which they were collected. For personal data that were sent by email, this is then the case when the respective conversation with the user has ended. The conversation is considered to have ended when it is apparent from the circumstances that the matter in question has been definitively resolved.

Ability to object and remove
You have the ability to object at any time to the processing of your personal data. For this purpose, we have set up the email address widerspruch@bbw-gruppe.de. However, you can also contact the recipient of the email directly.

Provision of the website and creation of log files


Description and scope of data processing
Each time our website is accessed, our system collects data and information in an automated manner from the system of the accessing computer. The following data are collected in this regard:

  • Information about the type of browser and the version being used
  • The user's operating system
  • The user's IP address
  • Date and time of day of access
  • Websites from which the user's system reached our website
  • Websites that the user's system accesses from our website

The data are likewise stored in the log files of our system. These data are not stored together with other personal data of the user. Personal user profiles cannot be created. The stored data are analysed only for statistical purposes.

Legal basis for data processing
The legal basis for the temporary storage of the data and the log files is processing for the purposes of our legitimate interest, i.e. of bbw.

Purpose of data processing
Temporary storage of the IP address by the system is necessary in order to make it possible to deliver the website to the user's computer. For this purpose, the user's IP address must remain stored for the duration of the session.

Data in log files are stored in order to ensure the functionality of the website. In addition, we use the data for the purpose of optimising the website and ensuring the security of our IT systems. The data are not analysed in this connection for marketing purposes.

These purposes also constitute our legitimate interest in data processing.

Storage period
The data are erased once they are no longer needed for fulfilling the purpose for which they were collected. If data are collected in order to provide the website, this is the case when the relevant session ends.

Where data are stored in log files, this is the case after at most seven days. Storage exceeding this is possible. In such case, the IP addresses of users are erased or scrambled so that they can no longer be attributed to the accessing client.

Ability to object and remove
The collection of data in order to provide the website and the storage of data in log files are essential for operation of the website. Accordingly, the user has no ability to object.

Use of cookies


Description and scope of data processing
Cookies are small files that enable us to store specific information about you, the user, on your computer while you are visiting our website. Cookies help us to ascertain the number of users of our website and how frequently it is used, as well as to design our offerings as comfortably and efficiently as possible for you.

We use what are known as session cookies, which are temporarily stored for the duration of your use of our website. Session cookies are stored on your data storage device in order to ensure certain settings and features on our website via your browser. The cookies we use are erased after the end of the browser session, i.e. after you close your browser.

Legal basis for the processing of personal data through use of technically necessary cookies is our legitimate interest in data processing.

Purpose of data processing
The purpose for using technically necessary cookies is to simplify the use of websites for users. Some of the features of our website may not be able to be offered without the use of cookies. For these features, it is necessary that the browser can be recognised also after accessing a different page. The user data collected by technically necessary cookies are not used to create user profiles.

Storage period, ability to object and remove
Cookies are stored on the user's computer and transmitted from it to our website. Therefore, you as user also have full control over the use of cookies. You can deactivate or restrict the transfer by cookies by adjusting the settings in your web browser. Cookies that have already been stored may be deleted at any time. This may also be accomplished in an automated manner. If cookies for our website are deactivated, it may be the case that some website features will no longer be able to be used to the full extent.

Your rights that you can exercise


If your personal data are processed, you are a data subject within the meaning of the GDPR, and you are entitled to the following rights with regard to the controller:

You have a right of access to information about your stored personal data, about the purposes of processing, about any transmissions to other entities, and about the period of storage.

If data should prove to be inaccurate, or if the purposes for which they were collected are no longer necessary, you can request rectification, erasure, or restriction of processing. Where envisioned in the processing procedure, you can also personally view and, if necessary, correct your data.

If reasons arise out of your special personal situation that prevent processing of your personal data, you can object to it if the processing is based on a legitimate interest. The controller may no longer process the personal data concerning you unless the controller demonstrates compelling legitimate grounds for the processing which override your interests, rights and freedoms or for the establishment, exercise or defence of legal claims. Where personal data concerning you are processed for direct marketing purposes, you have the right to object at any time to the processing of personal data concerning you for such marketing, which includes profiling to the extent that it is related to such direct marketing. Where you object to processing for direct marketing purposes or for profiling, the personal data concerning you may no longer be processed for such purposes.

You have the right to withdraw your consent to data processing at any time. The withdrawal of consent does affect the lawfulness of processing based on consent before its withdrawal.

Right to lodge a complaint with a supervisory authority


Without prejudice to any other administrative or judicial remedy, you have the right as a data subject to lodge a complaint with a supervisory authority for data protection, in particular in the Member State of your habitual residence or the place of the alleged infringement, if you consider that the processing of personal data relating to you infringes data protection.

The supervisory authority with which the complaint has been lodged must inform you on the progress and the outcome of the complaint, including the possibility of a judicial remedy.

Security


We implement technical and organisation security measures pursuant to Article 32 GDPR in order to protect your data managed by us against accidental or intentional manipulation, loss, or destruction, as well as against unauthorised access. Our security measures are continuously improved in keeping with technological developments. Access is possible only by a few authorised individuals and persons obligated to maintain special data protection who are tasked with the technical, administrative, or editorial supervision of data.
